Article 1 – Purpose and Scope
These General Purchase Terms (hereinafter referred to as the “Terms”) define the conditions under which Kakoo Kakoo, a company registered in Belgium, purchases or receives second-hand items voluntarily sent by individuals (hereinafter referred to as the “Customer”) as part of its Circular Program.
These Terms apply to any person who sends a batch of clothing or accessories to Kakoo Kakoo, whether or not store credit is issued.
By participating in the Circular Program, the Customer acknowledges that they have read and accepted these Terms, which are available at any time on www.kakookakoo.com
Article 2 – Principle of the Circular Program
Kakoo Kakoo’s Circular Program allows any customer to:
- send a batch of women’s clothing to be evaluated by Kakoo Kakoo;
- receive store credit under certain conditions, which can be used on the website;
- contribute to responsible consumption and extend the life cycle of clothing.
Article 3 – Conditions for Sending Items
3.1. General Conditions
The Customer agrees to send a minimum of twenty (20) items per batch.
Items must:
- be clean, dry, odor-free, and carefully folded;
- not contain stains, tears, holes, excessive pilling, or major defects;
- include size and brand labels whenever available;
- fall within accepted categories: women’s clothing, shoes, and accessories, according to the detailed list available on the website.
The complete list of accepted and refused items can be viewed at any time on the “Circular Program” page of www.kakookakoo.com
3.2. Shipment of the Batch
The Customer is free to choose their preferred shipping carrier (Bpost, Mondial Relay).
Shipping costs are the responsibility of the Customer but will be reimbursed in the form of store credit equivalent to the lowest standard shipping rate once the batch has been received and validated by Kakoo Kakoo.
The parcel must include an identification form containing the Customer’s full name, address, email address, and order number.
3.3 Temporary Suspension of Shipments
Kakoo Kakoo reserves the right to temporarily suspend the reception of new batches when storage capacity is reached or in the event of exceptional operational circumstances.
Customers will be informed directly on the website or through their account before sending any items.
Article 4 – Quality Control
4.1. Quality Control
Upon receiving the batch, Kakoo Kakoo carries out a detailed quality inspection.
Each item is evaluated based on:
- its overall condition (wear, stains, stitching, closures, elasticity, cleanliness);
- its resale potential;
- its relevance to customer demand and seasonality.
4.2. Acceptance Threshold
If at least eighty percent (80%) of the received items are considered to be in very good condition and eligible for resale, the Customer will receive store credit calculated according to the applicable terms.
If less than eighty percent (80%) of the items are considered eligible:
- no store credit will be issued for the value of the clothing;
- the Customer may request the return of their items, with return shipping costs remaining at their expense;
- if no written request is made within seven (7) days following the notification, the non-selected items will be donated to partner charities or recycled depending on their condition.
Items that are stained, torn, damaged, deformed, improperly washed, or that have persistent odors are automatically excluded and do not qualify for any compensation.
However, the initial shipping costs paid by the Customer will still be reimbursed in the form of store credit equivalent to the lowest standard shipping rate, even in the event of a full rejection of the batch, provided that the items meet minimum packaging and cleanliness requirements.
No cash payment will be made for refused or destroyed items.
Article 5 – Calculation of Store Credit
Store credit is issued when the batch reaches the eighty percent (80%) acceptance threshold.
Its value is determined:
- based on the estimated value of the accepted items;
- according to the pricing guidelines available on the website.
5.1. Shipping Cost Reimbursement
Shipping fees paid by the Customer are automatically converted into store credit of the same amount, valid for two (2) months, based on the lowest standard shipping rate.
5.2. Validity and Use
Store credit is valid for two (2) months from the date of issuance.
It may be combined with other Kakoo Kakoo credits but cannot be exchanged for cash.
Using the credit constitutes final acceptance: in the event of a later withdrawal from the order that generated this credit, the amount of any credit already used will be deducted from the refund owed to the Customer.
5.3. Valuation and Compensation for Accepted Items
Items deemed eligible for resale by Kakoo Kakoo are valued according to an indicative pricing grid available on the Circular Program page of the website.
This pricing grid outlines average compensation amounts by category (for example: tops, trousers, coats, accessories, etc.) based on condition and resale potential.
Kakoo Kakoo determines an overall batch valuation based on this pricing grid and the number of accepted items.
The Customer will then receive store credit corresponding to the total estimated value of the batch.
No item-by-item breakdown will be provided. Compensation is calculated globally based on Kakoo Kakoo’s internal evaluation.
This valuation is non-contractual and cannot be challenged individually.
Article 6 – Customer Responsibility
The Customer is solely responsible for the contents and packaging of the parcel sent to Kakoo Kakoo.
Any poorly packaged, unidentified, or non-compliant parcel may be refused without compensation.
Kakoo Kakoo declines all responsibility for loss, theft, damage, or shipping errors occurring before the parcel is physically received at its premises.
Article 7 – Ownership Transfer
Items accepted by Kakoo Kakoo become the exclusive property of Kakoo Kakoo once the sorting process has been completed and validated.
The Customer waives any claim regarding accepted or donated items.
Rejected items that are not claimed within the required timeframe also become the property of Kakoo Kakoo for donation, recycling, or destruction purposes, without any compensation.
Article 8 – Donation and Environmental Impact
Kakoo Kakoo prioritizes reuse and textile recovery.
Items that are not selected but remain usable may be donated to local partner charities.
No unsellable item will be placed back on the market.
Article 9 – Disputes and Mediation
Any dispute relating to the interpretation or execution of these Terms shall fall under the exclusive jurisdiction of the courts of Nivelles, Belgium.
Kakoo Kakoo encourages dialogue and mediation before any legal action is initiated.
Any complaint must be submitted by email to contact@kakookakoo.be within seven (7) days following receipt of the sorting notification.
Article 10 – Data Protection
Personal data collected as part of the Circular Program is processed in accordance with the Privacy Policy available on www.kakookakoo.com.
This data is necessary for the logistical and administrative management of the program.
The Customer has the right at any time to access, correct, or request deletion of their personal data.
Article 11 – Acceptance and Modifications
Participation in the Circular Program constitutes full acceptance of these Terms.
Kakoo Kakoo reserves the right to modify these Terms at any time.
Any updated provisions shall automatically apply to all shipments sent after their publication on the website.
