1. General provisions
These general terms and conditions define, without prejudice to the application of any specific terms, the respective obligations of KAKOO KAKOO in relation to all services and sales carried out by KAKOO KAKOO, whose registered office is located at Place Josse Gofin 12A, 1480 Tubize, Belgium, registered with the Belgian Crossroads Bank for Enterprises under company number BE1025.994.932, email address: contact@kakookakoo.be, hereinafter referred to as the “Seller”, and of any professional buyer or consumer wishing to make a purchase via the Seller’s website, hereinafter referred to as the “Buyer”.
By checking the box confirming acceptance of the general terms and conditions at the time of placing an order, the Buyer expressly acknowledges having had access to these terms, having read them, understood them, and accepted them without reservation, it being understood that any order placed for a product via our website implies prior consultation and express acceptance of these general terms and conditions of sale.
These general terms and conditions of sale may be saved or printed by the Buyer.
Any provisions from which no express derogation has been made shall remain applicable. Only derogations expressly agreed upon in writing may modify the application of these general terms and conditions. It is agreed that any specific provisions expressly accepted shall prevail over the general provisions in the event of any discrepancy. Furthermore, it is expressly agreed that in the event of any conflict between the customer’s general terms and conditions and those of KAKOO KAKOO, only the latter shall prevail.
The Seller reserves the right to amend its terms and conditions of sale at any time. In such case, the applicable conditions shall be those in force on the date the order is placed by the Buyer.
For the purposes of these Terms and Conditions:
Buyer: any natural person who has reached the age of majority and has full legal capacity or, failing that, such person’s legal representative. In the latter case, the legal representative shall be required to comply with these general terms and conditions.
Consumer: any natural person who purchases or uses products for purposes that exclude any professional or commercial activity.
2. Characteristics of the goods and services offered
Kakoo Kakoo is an online sales platform specializing in second-hand women’s clothing.
It offers a dual purchasing system, allowing customers to purchase items either through standard payment methods or by using a circular voucher obtained through the clothing collection program.
The products offered are listed in the online catalogue published on the website www.kakookakoo.com, subject to availability. Each item is a unique second-hand piece. Products are inspected, sorted, photographed, and labelled before being offered for sale.
Clothing sent to Kakoo Kakoo as part of the circular program must be clean, free from stains and odours, and comply with the quality criteria specified on the website.
Customers may purchase any item listed on the website using the available payment methods (bank card, Bancontact, etc.). Customers may also participate in the circular program by sending a minimum lot of twenty (20) clothing items to Kakoo Kakoo.
Following inspection and acceptance, a circular voucher will be issued, the value of which is determined based on the quality and estimated value of the items received. Shipping costs are reimbursed in the form of an additional voucher.
The circular voucher is valid for two (2) months, can be combined with other vouchers, and cannot be converted into cash. Each product is accompanied by a description prepared by Kakoo Kakoo based on the visual inspection carried out during the sorting process of the received items.
Photographs and videos are provided for informational and illustrative purposes only and do not have any contractual value. In the event of any discrepancy, the written information relating to the size, condition, and description of the item shall prevail. In the event of any discrepancy, the descriptions, sizes, and stated conditions shall prevail. Despite the care taken to keep the website updated, availability errors may occasionally occur.
As each item is unique, no replacement can be offered. In such cases, the order for the concerned item will be cancelled and the customer will be refunded at no additional cost. Items not selected as part of the circular program will not be returned to the customer, unless otherwise specified in the General Terms and Conditions of Purchase.
The full terms of the program (shipping conditions, selection criteria, 80% acceptance threshold, handling of unselected items, and voucher issuance) are detailed in the General Terms and Conditions of Purchase available on the website: www.kakookakoo.com
3. Order
3.1. Prerequisites
The Buyer wishing to purchase a product or service must:
- Be at least 18 years old;
- Complete the identification form or provide their customer number if they already have one;
- Complete the online order form by providing all references relating to the selected products or services;
- Acknowledge having read and accepted these general terms and conditions;
- Validate the order after reviewing it;
- Make payment under the agreed conditions;
- Confirm the order and payment.
3.2. Reservation and Validation
During checkout, items placed in the cart are reserved for ten (10) minutes.
After this period, if payment has not been completed, the reservation will automatically expire and the items will become available for sale again. An order shall only be considered valid once payment has been confirmed by Kakoo Kakoo.
In the event of partial or full payment made using a voucher or circular voucher, the order shall only be considered valid after automatic confirmation of the voucher and validation of any additional payment, where applicable. Vouchers used for an order cannot be reissued, exchanged, or converted into cash once the order has been validated. The provisions relating to the right of withdrawal are set out in Article 4 of these General Terms and Conditions.
3.3. Formation of the Contract
The sale shall only be deemed final after payment has been validated and the order has been expressly confirmed by KAKOO KAKOO. The automatic order receipt confirmation email does not constitute final acceptance.
Kakoo Kakoo also reserves the right to refuse or cancel any order in the event of an obvious pricing error, suspected fraud, abuse, or any previous dispute with the Buyer. No goods shall be shipped without order confirmation and receipt of full payment. As second-hand items are offered as unique pieces, in the event that an item becomes unavailable (already sold or removed from the catalogue), the order for that item will be cancelled and the Buyer will be fully refunded. No automatic replacement or reservation of a similar item is possible.
3.4. Abusive Behaviour, Fraud, and Misuse of the Website
The following actions shall be considered abusive behaviour, without this list being exhaustive:
- creating and using multiple accounts in order to obtain undue benefits;
- creating “loops” by intentionally placing multiple small orders in order to accumulate vouchers;
- abnormal exploitation of shipping or return costs;
- misuse of vouchers or circular vouchers;
- repeated or abusive returns;
- any attempt at fraud, manipulation, or circumvention of our commercial rules.
In the event of reasonable suspicion of such abuse, Kakoo Kakoo may temporarily suspend access to the account, cancel the relevant vouchers or circular vouchers, and/or refuse to issue new vouchers.
A prior warning will be sent to the customer in order to allow them to provide an explanation or correct the situation. In cases of serious, obvious, or repeated abuse, or in the absence of a response, Kakoo Kakoo may permanently delete the account.
3.5. Order Modification or Cancellation
Any request to modify or cancel a confirmed order must be sent by email to Kakoo Kakoo within a maximum period of twelve (12) hours following the order confirmation.
After this period, Kakoo Kakoo does not guarantee that cancellation will be possible, particularly if the order is already being prepared. This provision is without prejudice to the legal right of withdrawal applicable to distance sales.
3.6. Accuracy of Buyer Information
The Buyer is responsible for verifying the accuracy of their delivery address and contact details before confirming the order. Kakoo Kakoo shall not be held liable for any delivery issues resulting from incorrect information provided by the Buyer. Any reshipping costs incurred shall be borne by the Buyer.
3.7. Availability Confirmation
As each item is unique, availability is only confirmed once the order has been fully validated.
4. Right of Withdrawal
4.1. General Principles
In accordance with applicable legal provisions, consumers have the right to withdraw from their purchase without penalty and without providing any reason within fourteen (14) calendar days from the day following receipt of the order.
This right of withdrawal is reserved exclusively for consumers and does not apply to professional buyers.
4.2. How to Exercise the Right of Withdrawal
To exercise the right of withdrawal, the consumer must clearly and unequivocally notify KAKOO KAKOO of their decision before the expiration of the legal fourteen (14) day period.
This notification may be made directly through the customer account section on the KAKOO KAKOO website under: “My Orders” → “Request a Return.”
From the date of notification, the consumer has an additional period of fourteen (14) days to return the relevant item.
4.3. Conditions for Returning Items
Returned items must be sent back clean, unworn (except for fitting purposes), unwashed, complete, and in their original condition, including any labels and packaging where applicable.
KAKOO KAKOO reserves the right to refuse the return and/or limit the refund if the returned items do not comply with the above conditions.
4.4. Consumer Responsibility and Depreciation of Items
During the return process, the consumer remains responsible for the item until it is effectively received by KAKOO KAKOO.
The consumer may be held liable for any depreciation in value resulting from handling beyond what is strictly necessary to establish the nature, characteristics, and proper fit of the product.
In such cases, KAKOO KAKOO reserves the right to issue a partial refund if the returned item is incomplete, damaged, or in a condition that prevents it from being resold.
4.5 Effects of Withdrawal and refund terms
In the event of withdrawal, KAKOO KAKOO shall reimburse all payments received from the Buyer, including the initial delivery costs corresponding to the least expensive standard delivery method offered, even if the customer selected a more expensive delivery option. Return shipping costs are excluded from the refund.
The refund shall be made without undue delay and no later than fourteen (14) days from the date on which the customer notifies KAKOO KAKOO of their decision to withdraw.
However, KAKOO KAKOO reserves the right to delay the refund until the returned items have been effectively received or until the customer provides proof of shipment, whichever occurs first.
In the event of a partial withdrawal (return of only part of the order), the initial delivery costs will not be fully refunded. The refund may be limited to the proportional value of the returned items or may not be due.
The reimbursement of delivery costs is limited to the least expensive standard delivery option available on the website, even if a more expensive delivery option was selected.
Unless expressly agreed otherwise in advance, items returned from the same order must be sent back in a single shipment. Multiple partial returns for the same order will not be accepted.
Specific Provisions Regarding Vouchers and Circular Vouchers
Once a voucher or circular voucher has been used, it is considered definitively consumed.
In the event of withdrawal from an order that generated or used a voucher or circular voucher:
- the value of the voucher already used will automatically be deducted from the refund amount;
- if the voucher has been used on another order before the withdrawal request, the refund will be adjusted to reflect the benefit already granted;
- no cash refund may exceed the amount actually paid by the customer;
- no additional refund will be granted for a voucher already used on a delivered order.
4.6. Specific terms for payments made using vouchers or circular vouchers
When an order is paid in whole or in part using a voucher or circular voucher, the following conditions apply:
- no cash refund will be issued for the portion of the order paid using a voucher or circular voucher;
- in the event of withdrawal, the portion paid using a voucher or circular voucher may, where applicable, be refunded in the form of a new voucher, in accordance with the applicable issuance conditions;
- these provisions also apply to vouchers granted as compensation, including those related to shipping costs, the circular program, or any commercial gesture.
4.7. Items excluded from the right of withdrawal
The right of withdrawal does not apply to:
- items offered free of charge as part of an order, contest, or promotional campaign;
- sealed items that cannot be returned for hygiene or health protection reasons (including underwear, swimwear, earrings, or similar items).
4.8. Additional provisions
Initial shipping costs and, where applicable, return shipping costs may give rise to the issuance of a voucher equivalent to the least expensive standard shipping rate offered by KAKOO KAKOO, in accordance with the conditions specified in the summary table.
Shipping costs initially paid by the customer may be converted into an equivalent voucher valid for a future purchase on the website. This voucher is only issued once the legal withdrawal period has expired.
Vouchers and circular vouchers are neither refundable nor convertible into cash.
In the event of withdrawal from an order in which a voucher or circular voucher was used, the value of the voucher used shall, where applicable, be deducted from the refund due to the customer.
Where all or part of a voucher or circular voucher has been used for a new order before the right of withdrawal is exercised on the original order, the refund will be adjusted to reflect the benefit already granted.
No cash refund may exceed the amount actually paid by the customer through a standard payment method. No additional refund shall be granted for a voucher already used on a delivered order.
Vouchers and circular vouchers may be combined unless expressly stated otherwise at the time of issuance.
5. Duration
These terms and conditions apply from the moment the user accesses the website and, where applicable, creates a customer account.
They remain applicable throughout the entire ordering process, including the preparation and delivery of goods, as well as for any subsequent contractual relationship directly related to an order placed on the website, including matters relating to after-sales service, returns, warranties, and dispute resolution.
6. Delivery – Shipping
Shipping Time
Kakoo Kakoo undertakes to dispatch orders within one (1) to two (2) business days following payment confirmation.
Delivery Time
Standard delivery times are usually:
- 3 to 8 business days within Belgium
- 5 to 10 business days for other countries within the European Union
These delivery times are provided for informational purposes only and may vary depending on the carrier selected by the Buyer, the chosen delivery method (home delivery or pickup point), and circumstances beyond our control.
Shipping fees are calculated based on the total weight of the parcel, the selected carrier, and the delivery destination.
Full details regarding delivery areas, rates, and estimated delivery times are available on the Shipping & Returns page.
The delivery times indicated are estimates only. No compensation may be claimed for delays beyond KAKOO KAKOO’s control, without prejudice to the consumer’s legal rights.
Delivery Address and Delivery Method
Deliveries are made either to the address provided by the Buyer when placing the order or to the selected pickup point.
Unclaimed Parcel
If the Buyer is absent during home delivery or fails to collect the parcel within the deadline set by the carrier or pickup point, the parcel will automatically be returned to Kakoo Kakoo.
In such cases, the Buyer will be refunded for the amount of the order, minus the shipping costs already incurred, or may request a new shipment subject to payment of additional shipping fees.
As a commercial gesture, shipping fees paid at the time of the order may be converted into a voucher equivalent to the lowest standard shipping rate, which may be used for a future purchase.
Transport Risks
For sales made to consumers, goods remain at Kakoo Kakoo’s risk until effective delivery.
For sales made to professional buyers, transport shall be at the Buyer’s risk.
Delivery Delay
In the event of a delivery delay exceeding fifteen (15) calendar days, the Buyer may cancel the purchase without compensation for either party, provided that Kakoo Kakoo is notified by email within a reasonable period following notification of the delay.
The Buyer will then be refunded the full amount of the order, including any shipping costs, through the same payment method used for the order unless the Buyer agrees otherwise. The refund will be processed within fifteen (15) calendar days.
The parties shall then be fully released from their respective obligations.
Force Majeure
In all cases, the following circumstances release Kakoo Kakoo from its obligations regarding delivery deadlines:
- cases of force majeure (including technical incidents, strikes, severe weather conditions, carrier delays, labour shortages, or any other circumstances beyond our control);
- modifications requested by the Customer after the order has been placed.
7. Pricing
The prices of products displayed on the website are indicated in euros and include all applicable taxes (VAT and any other applicable taxes).
Shipping costs are not included in the price of the items and are indicated separately during the checkout process.
All orders must be paid in euros. Kakoo Kakoo does not accept any other currencies.
The applicable prices are those in force at the time the order is confirmed. Kakoo Kakoo reserves the right to modify its prices at any time and to reflect any changes in VAT rates occurring before the delivery date.
Promotions, discounts, and promotional codes are valid only during the announced validity period and cannot be combined unless clearly stated otherwise on the website.
In the event of an obvious pricing error (including a clearly unreasonable or disproportionately low price), KAKOO KAKOO reserves the right to cancel the relevant order.
In such cases, the Buyer will be informed as soon as possible and fully refunded for the amount paid.
Shipping or return costs reimbursed in the form of a voucher constitute a commercial gesture and may not be considered a price reduction or give rise to any cash refund.
As the items offered on Kakoo Kakoo are second-hand products, prices take into account their condition at the time of sale.
8. Payment terms
Payment is made online at the time of the order using the payment methods available on the website, including bank card (Visa, Mastercard), Bancontact, and any other payment solutions offered through our secure payment provider.
Payments are protected by an SSL encryption system through our payment provider (such as Stripe, Mollie, or any equivalent provider). Kakoo Kakoo does not store customers’ banking details under any circumstances.
An order is considered final only once payment has been validated by the banking institution. Kakoo Kakoo reserves the right to suspend or cancel any order in the event of non-payment or suspected fraud.
No deferred payment is accepted.
Payment may be made in full or in part using a voucher or circular voucher, in accordance with the conditions provided on the website.
Ordered items remain the exclusive property of Kakoo Kakoo until full payment of the order has been received from the Buyer.
Any complaint relating to a payment or transaction may be sent by email to: contact@kakookakoo.be as soon as possible.

10. Legal warranty
In accordance with Article 1649quater §2 of the Belgian Civil Code, the consumer must inform the Seller of the existence of any lack of conformity within two (2) months from the day on which the consumer discovered the defect.
Second-hand items sold on KAKOO KAKOO benefit from a legal conformity warranty of one (1) year from the date of delivery.
Any lack of conformity appearing within six (6) months from the delivery of the item shall be presumed to have existed at the time of delivery, unless KAKOO KAKOO proves otherwise.
This warranty only covers defects of conformity that existed at the time of delivery of the item.
Warranty Exclusions
The warranty does not cover:
- Normal wear and tear of items (e.g. fabric naturally wearing over time, loss of elasticity, fabric pilling, natural fading caused by washing or sun exposure);
- Damage caused by improper care (e.g. washing contrary to care instructions, unsuitable drying, ironing at excessively high temperatures, unauthorized dry cleaning);
- Damage resulting from negligence or improper use (e.g. stains, snags, tears, burns, iron marks, deformation caused by improper storage, contact with chemicals);
- Voluntary alterations or modifications (e.g. stitching altered by a third party, shortening, dyeing, customization).
The warranty is personal to the original Buyer and does not apply in the event of resale or transfer of the item to a third party.
The invoice or delivery note serves as proof of warranty and must be retained by the consumer and presented, where applicable, in electronic format.

12. Refunds
Refunds shall be processed without undue delay and no later than fourteen (14) calendar days from the date on which the consumer notifies KAKOO KAKOO of their decision to withdraw from the purchase.
However, KAKOO KAKOO reserves the right to delay the refund until the returned items have been effectively received or until the consumer provides proof of shipment, whichever occurs first.
The refund shall apply exclusively to the amount actually paid by the consumer after the application of any discounts, promotional codes, or vouchers.
Discounts and vouchers used for the purchase do not entitle the consumer to any cash reimbursement.
1) Payment made online
Where payment was made by bank card or through any other secure payment provider used by KAKOO KAKOO, the refund will be made using the same payment method used for the original order.
Initial delivery costs will be refunded only up to the amount corresponding to the least expensive standard delivery method offered by KAKOO KAKOO, even if the consumer selected a more expensive delivery option.
Return shipping costs remain the responsibility of the consumer.
2) Payment made (in whole or in part) using a voucher
The portion of the purchase price paid using a voucher or circular voucher will be refunded exclusively in the form of an equivalent voucher.
Where the initial delivery costs were paid using a standard payment method, they will be refunded through that same payment method, up to the amount corresponding to the least expensive standard delivery method offered.
Return shipping costs remain the responsibility of the consumer.
13. Refunds
The Seller’s obligations in the online sales process are considered obligations of means within the meaning of Article 5.72 of the Belgian Civil Code.
The Seller undertakes to use all reasonable means to ensure quality service and secure online transactions, without prejudice to any mandatory legal guarantees applicable to consumers.
However, the Seller cannot be held liable for damages resulting from the use of the internet network or online payment systems (including data loss, unauthorized access, viruses, service interruptions, or other issues beyond its control), provided that such events are not caused by any fault attributable to the Seller.
The Seller’s liability may not be engaged, directly or indirectly, on any grounds whatsoever, except in cases of gross negligence or intentional misconduct (fraud).
By way of derogation from Article 5.229 of the Belgian Civil Code, the Seller remains liable for its agents or service providers in accordance with mandatory legal provisions applicable to consumer relationships. These limitations of liability apply in compliance with the mandatory provisions of Book VI of the Belgian Code of Economic Law and do not affect the rights granted to consumers under applicable legislation.
